Factors Considered in Cases Involving Maintenance
Before the Denver family courts will award maintenance to one spouse or another, they will consider a vast array of factors. These factors will not only determine which spouse is eligible for maintenance, if any, but will also determine how much spousal support is to be paid.
When looking at divorce cases that involve maintenance, the family courts will consider:
- the length of the marriage
- the ability of the “dependent” spouse (spouse that is seeking maintenance) to earn a living or re-enter the career force
- the financial resources the dependent spouse has at his/her disposal
- who has custody of the children
- the standard of living that was established throughout the marriage
- the age and physical health of the dependent spouse
- the role of each spouse throughout the marriage (i.e. who stayed at home and who worked)
