Common Divorce Questions

If you are about to go through a divorce in Denver, chances are that you have a few questions about divorce eligibility requirements and the divorce process in general.  Below, the Thode Law Firm has provided answers to commonly asked questions our firm receives:

1.  What are the residency requirements? In Colorado, you must reside in the state at least 90 days before you can file a divorce petition.

2.  If my spouse and I agree on everything, do we need a Denver divorce lawyer? Yes, you still should each have your own divorce attorney.  Even though you and your spouse may be in agreement, it is a well-known fact that lawyers can make sure your divorce is carried out swiftly, and also protect your best interests.

3. What are the grounds for divorce? Colorado allows people to dissolve their marriages if their marriages are “irretrievably broken”.  In other words, people can have “no fault” divorces.

4.  How do divorce proceedings start? The divorce process begins when one spouse files a “petitions and summons” with the courts.

5.  How long does it take for a divorce to be final? The amount of time it takes for a divorce to be final in the state of Colorado varies case-to-case and will depend upon the issues that are involved.
